Samsung Break Free offer: Terms & Conditions

• Provided by: Samsung India Electronics Pvt. Ltd.
• Offer period, Place & Outlet Coverage: 05th November to 31st December 2018 including both days (“Offer Period”). Offer shall be available on purchase of Products from authorized general trade & modern trade outlets, Samsung Shop (i.e. Samsung e-store) and other e-commerce portals (“Offline Outlets & Online Outlets”).
• Product Coverage (“Products”): A6+, A8+, A7 2018 (128GB & 64GB), A9, A8 Star, S9, S9+ (128Gb & 64GB), J4+, J6 (64GB & 32GB) , J6+ (64GB & 32GB), J7 Duo, J8, Note 9 (512GB & 128GB)
• Eligibility Criteria:
• Customer needs to purchase the new Product during the Offer Period and activate the IMEI on the purchased Product during the Offer Periods (“Activation Date”).
• One Time Screen Replacement at LKR.950/- can be availed only if the Product screen is broken for any reasons whatsoever. Any scratches on the screen or damage due to liquids/fluids shall not be covered under this Offer. To qualify the screen as damaged shall be subject to the discretion of the Samsung authorized service centers.
• Offer shall be applicable only on new Product(s) purchased during the Offer Period. Demo units sold to customers or any bulk sale to corporate or any other institute or individual shall not be eligible for this Offer.
• Offers: One Time Screen Replacement. One Time screen replacement at just LKR. 950/= within 12 months from the Activation Date during the Offer Period.
• Redemption of One Time Screen Replacement offer:
• Customer who has purchased and activated the Product during the Offer Period shall be eligible to avail the One time screen replacement offer by paying just LKR.950/=. The Offer can be availed starting from 7th day post the Activation Date of the Product till a period of 12 months.
• Offer can be availed only once by visiting the authorized service center of Samsung.
• Verification of the documents:
• Before availing the Offer, it is mandatory to handover a copy of the invoice to the authorized service center, issued by the respective Online or Offline Outlet at the time of purchase of the Product and produce the original invoice along with the same for verification.
• In case any documents/invoice are found to be false & fabricated or the original invoice is either lost or torn, the Customer shall not be eligible for the Offer and the same shall stand forfeited and no claims shall be entertained in this regard.
• Forfeiture clause: For One time screen replacement offer – (i) In case the Customer activates the Product after the Offer Period he/she shall not be eligible for the Offer. (ii) If the Customer doesn’t avail this offer within 12 months from the Activation Date (i.e. during the stipulated time as mentioned above in the eligibility criteria column) the Offer shall stand lapsed and no claims will be entertained in this regard against Samsung.
• Conditions related to One time screen replacement offer:
• One time screen replacement shall be on As Is basis and subject to part(s) availability. Samsung shall not be responsible for its non-availability due to various reasons like climatic conditions, labour unrest, insolvency, business exigencies, Government decisions, operational & technical issues or any other force majeure conditions etc.
• Offer cannot be exchanged with any other product or item, and is non-transferable & cannot be encashed under any circumstances.
• Publicity: Customers unconditionally consent to accessing/use of information and/or images of Participant (if any, clicked or shared by Customer) by Samsung or its authorized agency for media coverage, advertisement or publicity for present & future communications without any further consideration to the Participant including promotion of its products anywhere in the World.
• General Conditions:
• Participation to the Offer is voluntary. Participation under this Offer constitutes acceptance of these terms and conditions. By availing this Offer, Customer(s) agrees to receive communication(s) from Samsung or its event management company relating to the Offer and Customer(s) unconditionally agrees not to make any claim or raise any complaint against Samsung or the event management company in this respect.
• Availing the Offer implies that Customers agree to all Terms of the Scheme. Anybody found using any unfair means will be immediately disqualified.
• Customer availing the Offer agrees and consents that information submitted by them including but not limited to submissions and personal information of Customers may be required to be shared with other third parties engaged by Samsung, for the purposes of verifying and/or audit the authenticity of the entries received from Customers.
• Customer agrees that Samsung shall not be liable for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Offer or with the acceptance of this offer.
• Samsung reserves the right to change/alter & modify the terms & conditions of this Offer or extend or annul any part or whole offer at any given point at its sole discretion without notice / without giving any reason or notice whatsoever.
• Samsung reserves the right to substitute the One Time Screen Replacement offer and other offers with some other gift(s) of equivalent value under this Offer at its sole discretion without giving any reasons.
• Samsung shall not be liable for any technical, physical delay in transmission or submission of the entries by the customer or any disruptions, losses, damages, computer related malfunctions/ failures which affect the participation of the customer or any force majeure conditions or damages caused by Act of God, Governmental actions.

• Failure by Samsung to enforce any of its right at any stage does not constitute a waiver of those rights.
• In no event shall Samsung be liable for losses or any incidental or consequential damages arising out of or in connection with the Offer, its services these Terms(however arising, including negligence). Samsung shall not be responsible for any product or service liability of any kind.
• The event of any conflict or inconsistency regarding any instructions, rules and conditions on any advertising or promotional material relating to the Offer, these Terms shall prevail over all such other instructions, rules and conditions.
• Decision of Samsung in relation to the Offer and matter incidental thereto shall be final and binding on the customer.
• Samsung reserves the absolute right to amend the Terms of the Offer or extend the Offer Period or cancel or discontinue the Offer or any part thereof without giving any reasons or prior notice.
• Jurisdiction: All disputes shall be governed by the laws of India. These Terms shall be governed by exclusive laws of India and the courts located at Delhi shall have the exclusive jurisdiction in respect of all the subject matter with relation to the Offer.
